النظام القانوني لملحق الصفقة العمومية

Abstract

الملخص لقد عمد المشرع الجزائري على تحقيق نوع من التوازن بين مصلحة الإدارة و المتعامل معها ، وقد منح للإدارة سلطة تعديل صفقاتها عن طريق آلية الملحق الذي تعد وثيقة تابعة للصفقة وما يميزه عن الصفقة الأصلية ودفاتر الشروط وهذا الإجراء حتى يضفي طابع المشروعية عليه لابد من توفر مجموعة من الشروط المحددة قانونا وكما أن عملية إبرام الملاحق لها مجموعة من القيود والدوافع ، ومن أهم آليات التي جاء بها المشرع الجزائري للملحق آلية الرقابة الخارجية و آلية تسوية المنازعات والمتمثلة في التسوية الودية والتسوية القضائية. Résumé : Il a eu un équilibre entre le département deservice contractant et le partenaire contractant grâse a au projet Algérien qui a permet à l̛administration le pouvoir de gérer ses marché via avenant qui est considéré comme document lié à marché , est sur qu’ ̛il va le distinguer à marché principal est le cahier de charge cette procédure a permis le donner plus de légitime et fiabilité pour ça il faut remplir l̛ensemble des conditions déterminant aussi sur les opérations des avenants conclu a besoin des restrictions et des motifs est parmi les mécanismes qui as apporté le projet algérien à l̛avenant ˸ control externe , règlement des litige via le règlement judiciaire . Abstract: The Algerian legislator has achieved a kind of balance between the interest of the administration and the contracted market, and also gave the administration the authority to amend its market through the annex mechanism, which is considered a document affiliated with the market, and what distinguishes it from the original deal and the books of conditions, in order for this procedure to confer legitimacy on it, a set of legally defined conditions must be met, and the process of concluding annexes has a set of restrictions and motives. Among the most important mechanisms that the Algerian legislator brought to the appendix are ˸ the external control mechanism and the dispute settlement mechanism (friendly and judicial settlement)
