سلطة المصلحة المتعاقدة في تعديل الصفقة العمومية بين الإرادة المنفردة والحفاظ على مبدأ العقد شريعة المتعاقدين

Abstract

الملخص: إن سلطة المصلحة المتعاقدة في تعديل الصفقة العمومية يعد حقا مقررا قانونا، وذلك للحفاظ على المصلحة العامة والسير الحس للمرفق العام، وتعتبر ممارسة المصلحة المتعاقدة لسلطة التعديل الانفرادي لشروط الصفقة بمثابة امتياز وضمان لسير تنفيذها على النحو المتفق عليه مع المتعامل المتعاقد، حيث أنها مقيدة بضوابط على الإدارة احترامها، وذلك عن طريق آلية قانونية تتمثل في الملحق فالإدارة المتعاقدة لا تمتلك حق تعديل الصفقة إلا في ظروف معينة وبضوابط وشروط مما يجعل المساواة قائمة في العقد الإداري. االمصلحة المتعاقدة-سلطة التعديل الانفرادي-الصفقة العمومية-المتعامل المتعاقد-الملحق. Résumé : Le pouvoir de l’intérêt adjudicateur à modifier la donne publique est considéré comme un droit légalement établi, afin de préserver l’intérêt public et la bonne conduit du service public . Avec des contrôles que l’administration doit respecter , à travers un mécanisme légal représenté dans l’annexe ,l’administration contractante n’a pas le droit de modifier la transaction sauf dans certaines circonstances et avec des contrôles et des condition, ce qui fait que l’égalité existe dans le contrat administratif :l’intérêt contractant- l’autorité de modification unilatérale-le marché public-le maitre d’ouvrage –l’annexe. Summary: The authority of the contracting interest in modifying the public deal is considered a legally established right ,in order to preserve the public interest and the good conduct of the public utility. With controls that the administration must respect through a legal mechanism represented in the annex ,the contracting administration does not have the right to amend the deal except in certain circumstances, and with controls and conditions, which makes equality existing in the administrative contract.
