الخطأ المهني الجسيم في القانون الأساسي للوظيفة العمومية

Abstract

- ملخص: يعد الحق في العمل من أهم الحقوق التي يتمتع بها الفرد في إطار الدولة وتتجلى هاته الأهمية في تكريسه بنص الدستور في تحويلاته المختلفة، فالدستور الجزائري وضع الإطار العام لهذا الحق بجعله حقا مكفولا لكل مواطن جزائري، بلوأكثر من ذلك فقد نص على القدر الأدنى من الشروط الواجب توفيرها لمواطن عند ممارستها لهذا الحق من حماية أمن ونظافة، وحق في الراحة وهي أمور التي يضمنها القانون، هاته الأهمية حتمت على المشرع سن أرمادة من النصوص القانونية الكافية بضمان هذا الحق وبضمان التمتع به في أحسن الظروف، وذلك باختلاف القطاعات وتماشيا مع الظروف الإجتماعية و السياسية.

- Résumé: Le droit de travail parmi les droits le plus importants apprécié par chaque individu et cette importance est reflété de la constitution dans divers amendements. La constituions algérienne se base t’il de rendre ce droit nécessaire pour chaque citoyen, et encore plus un droit fourni au citoyen lors de l’exerçants ce droit de protection de la sécurité et de la propreté , et ils sont garantis par la loi. Cette importance oblige le législateur d’adopté des lois pour garanti ce droit et le pratique en mieux, et cela a travers des différents secteurs en phase avec les conditions politique et social. - Summary : The right to work is one of the most rights enjoyed by andivudual in the state and its reflected this importance in the consercation of the constitution in various conversious so the algerian constitution developed a general from work to this right which becom guaranted right to every algerian citizen and more than that stuplished the minimum condition that must provide to each citizen when he do his normal right from clean lines security and the right of confort that includes the constitution . This importance dictated to the project to put some enaught laws to insolidarity this right and to enjoy of it in better conditions this is defference each branche in line social political conditions.
