Abstract

الملخص: تعتبر جريمة إساءة إستعمال أموال الشركة أحد أخطر الجرائم الماسة بالذمة المالية للشركة وقدرتها الإئتمانية، وقد اعطى لها المشرع أهمية كبيرة من خلال وضع القواعد الموضوعية والإجرائية لها، حيث ينحصر مجال تطبيق هذه الجريمة في نوعين من الشركات دون غيرهما، شركات المساهمة وشركات ذات المسؤولية المحدودة، دون غيرها من الشركات الأخرى، ورغم الأهمية التي تكتسبها هذه الجريمة وآثارها السلبية على سير الشركة، إلا أن المشرع بحصر مجالها قد يكون حدّ من تطبيق النصوص الجزائية المجرمة لفعل الاستعمال التعسفي لأمال الشركة، ومن ثم إفلات العديد من الجناة من العقاب. Résumé : Cette crime est l’une des infraction les plus grave contre l’aspect financier de ma société et de sa capacité d’exécuter ses engagement, le législateur de règle de fond et de procédure, le champ d’application de cette crime était présent dans deux types d’entreprise et pas d’autre société par action et société a responsabilité limitée, sans autres entreprises, malgré l’importance que l’entreprise, cependant le législateur confinée, sa portée peut avoir l’application de sanctions pénales pour l’acte d’utilisation l’argent de la société arbitraire et ensuite laisser toner beaucoup de la propriété les contrevenants.
