Abstract

الملخص: يعد الإرشاد البحري من أقدم عقود الملاحة البحرية فهو المساعدة التي تقدم إلى الربان من قبل السلطة المينائية لقيادة السفن عند الدخول إلى الموانئ أو الخروج منها والمراسي والمياه الداخلية، فالمرشد ملزم بتقديم المساعدة للربان بمجرد تلقي طلب النداء وتقديم المساعدة للسفينة التي تتقدم أولا دون اختيار، وباعتبار أن عقد الإرشاد البحري عبارة عن علاقة بين ربان السفينة والمرشد البحري فإنه يترتب عنه التزامات على عاتق الطرفين، وفي حالة مخالفة هذه الالتزامات تقع المسؤولية على كل الأطراف، كما يحق لكل الطرفين لما له من صفة أو مصلحة رفع دعواه وفقا للقواعد العامة للاختصاص القضائي.

Résumé: Le pilotage maritime est l'un des contrats de navigation maritime les plus anciens. Il s'agit de l'assistance fournie au capitaine par l'autorité portuaire pour conduire les navires à l'entrée ou à la sortie des ports, des mouillages et des eaux intérieures. Le pilote est tenu d'assister le capitaine dans les plus brefs délais. il reçoit la demande d'appel et apporte l'assistance au navire qui vient en premier sans choix, et considérant Le contrat de pilotage maritime est une relation entre le capitaine du navire et le guide maritime Il entraîne des obligations pour les deux parties. En cas de violation de ces obligations, la responsabilité incombe à toutes les parties. Les deux parties ont également le droit, en raison de leur capacité ou de leur intérêt, d'introduire leur action en justice conformément aux règles générales de compétence judiciaire.

Abstract: Maritime pilotage is one of the oldest maritime navigation contracts. It is the assistance provided to the captain by the port authority to drive ships when entering or leaving ports, anchorages and inland waters. The pilot is obligated to provide assistance to the captain as soon as he receives the call request and to provide assistance to the ship that comes first without choice, and considering The maritime pilotage contract is a relationship between the captain of the ship and the marine guide. It entails obligations on both parties. In the event of a violation of these obligations, responsibility falls on all parties. Both parties also have the right, due to their capacity or interest, to file their lawsuit in accordance with the general rules of judicial jurisdiction.
