حوكمة الصفقات العمومية في ظل القانون رقم 23-12

Abstract

ملخص: تتناول هذه الدراسة موضوع حوكمة الصفقات العمومية في ظل القانون رقم 23-12، من خلال إبراز مدى مساهمة هذا القانون في تكريس مبادئ الحوكمة الرشيدة داخل منظومة الصفقات العمومية بالجزائر. وقد تم التطرق إلى المفاهيم الأساسية للحوكمة وعلاقتها بالصفقات العمومية، مع بيان التطور التشريعي والتنظيمي الذي عرفه هذا المجال. كما عالجت الدراسة أهم المستجدات التي جاء بها القانون 23-12، بما يشكل خطوة مهمة نحو حماية المال العام وتحسين فعالية تسيير الصفقات العمومية.

ABSTRACT: This study addresses the subject of public procurement governance under Law No. 23-12 by highlighting the extent to which this law contributes to consolidating the principles of good governance within the public procurement system in Algeria. The study examines the fundamental concepts of governance and their relationship with public procurement, while also outlining the legislative and regulatory developments that have characterized this field. Furthermore, the study discusses the major innovations introduced by Law No. 23-12, which constitute an important step toward the protection of public funds and the enhancement of the efficiency of public procurement management.
