Abstract

الملخص: تعالج هذه الدراسة أثر التطور التكنولوجي في مجال إثبات النسب، من خلال إبراز التحول الذي عرفته وسائل الإثبات من الأساليب التقليدية القائمة على الفراش والإقرار والبينة، إلى الوسائل العلمية الحديثة وفي مقدمتها البصمة الوراثية. وتهدف الدراسة إلى بيان مدى إسهام التقنيات الطبية المعاصرة في تحقيق اليقين البيولوجي وحماية الأنساب من الضياع، مع التطرق إلى الإشكالات القانونية والأخلاقية التي أفرزتها التقنيات التناسلية المستحدثة، خاصة التلقيح الاصطناعي. وقد اعتمدت الدراسة على المنهج الوصفي والتحليلي والمقارن، من خلال تحليل النصوص القانونية والآراء الفقهية والقضائية ذات الصلة. وخلصت إلى أن البصمة الوراثية تمثل من أدق وسائل إثبات النسب وأكثرها حجية، الأمر الذي يقتضي مراجعة التشريع الجزائري بما يواكب التطور العلمي، مع تكريس سلطة القاضي في تحقيق التوازن بين الحقيقة العلمية ومصلحة الطفل الفضلى واستقرار الروابط الأسرية. Abstract: This study examines the impact of technological evolution on the proof of lineage (paternity), highlighting the shift from traditional methods—based on the marital bed (Al-Farash), acknowledgment, and testimony—to modern scientific means, primarily DNA profiling. The study aims to clarify how contemporary medical techniques contribute to achieving biological certainty and protecting lineage from being lost, while addressing the legal and ethical dilemmas created by modern reproductive technologies, particularly artificial insemination. Utilizing descriptive, analytical, and comparative methodologies, the research analyzes relevant legal texts, Islamic jurisprudence, and judicial opinions. The study concludes that DNA fingerprinting is one of the most accurate and authoritative methods for proving lineage, necessitating a revision of Algerian legislation to keep pace with scientific advancements. Furthermore, it emphasizes empowering the judiciary to balance scientific truth with the best interests of the child and the stability of family ties.
