آلية ملتمس الرقابة في ظل النظام الدستوري الجزائري

Abstract

الملخص: لقد منح المؤسس الدستوري الجزائري البرلمان وسائل عديدة لمراقبة الحكومة وإقامة مسؤوليتها السياسية، ومن بين هذه الوسائل ملتمس الرقابة التي تعتبر آلية جد خطيرة بيد مخططها الذي وافق عليه البرلمان. ونظرا لخطورة ملتمس الرقابة، فقد أحاطها المؤسس الدستوري والمشرع بمجموعة من الشروط التي تبقى نوعا ما شبه مستحيلة أو تعجيزية لنواب المجلس الشعبي الوطني، وذلك إما بفعل النصاب المطلوب للتوقيع عليه أو المصادقة أو المدة الممنوحة للتصويت، أي أن ملتمس لا ينجح، وهذا معناه عدم إمكانية إسقاط الحكومة. Résumé: Le fondateur constitutionnel algérien a donné au parlement de nombreux moyens pour contrôler le gouvernement et établir sa responsabilité politique, parmi lesquels la motion de censure, qui est un mécanisme très dangereux entre les mains de son plan, qui a été approuvé par le parlement. Compte tenu de la gravité de la motion de censure, le fondateur constitutionnel et législatif la entourée d'un ensemble de conductions qui restent quelque peu impossibles ou impossibles pour les députées de l'Assemblée populaire nationale, soit en raison du quorum requis pour la songer, soit en raison de la ratification ou de la période accordée pour le vote, ce qui signifie que le pétitionnaire ne réussit pas et que le gouvernement ne peut donc pas être renversé. In view of the seriousness of the motion of censorship, the constitutional and legislative founder has surrounded it with a set of conditions that remain somewhat near impossible or incapable of the deputies of the national people's Assembly, either due to the quorum required to sign it or ratification or the period granted for the vote, meaning that the petitioner does not succeed and this means that the government cannot be overthrown.
