الأقطاب الجزائية المتخصصة كآلية لمكافحة الجريمة

Abstract

ملخص: إستحدث المشرع الجزائري الأقطاب الجزائية كجهاز قضائي متخصص لمكافحة الجريمة الموصوفة بالتعقيد والخطورة والحد من انتشارها، ورصد آليات وإجراءات خاصة تمكنها من القيام بعملها بصفة فعالة وسريعة. وتتميز الأقطاب الجزائية المتخصصة باختصاصها المحلي الموسع، بالإضافة إلى اختصاصها بالنظر فقط في الجرائم التي حددها لها القانون. لم يحدد المشرع الجزائري قواعد إجرائية خاصة بل أخضعها إلى القواعد العامة المعمول بها في المحاكم العادية، إلا أنه جعل لها بعض الخصوصيات لا سيما في مجال اتصالها بملف الدعوى، والوسائل والآليات المستحدثة المتاحة لها للبحث والتحري والتحقيق فيها. Résumé : Le législateur algérien a institué les pôles pénaux spécialisés comme organe judicaire spécialisé pour lutter contre la délinquance qualifiée de complexe et dangereuse et pour en limiter la propagation et pour surveiller les mécanismes et procédures spéciales qui lui permettent de mener a bien travail de manière efficace et rapide. Les pôles pénaux spécialisés se caractérisent par leur compétence territoriale élargie, en plus de leur compétence à ne connaitre que des infractions qui leur sont prévues par la loi. Le législateur algérien n’a pas précisé les règles de procédure particulières, mais les a plutôt soumises aux règles générales applicables devant les juridictions ordinaires, mais il leur a apporté quelques spécifiés notamment le domaine du contact avec le dossier, et les nouveaux moyens et mécanismes disponibles a aux pour la recherche l’investigation et l’investigation.
