الملخص : أمام شمولية الحروب وتطور وسائلها وأساليبها من جهة، ومن جهة أخرى تعدد التشكيلات العسكرية وكثرت التسميات الدالة على تشكيلة مقاتلة، دفع بالعاملين في القانون الدولي الانساني إلى محاولة وضع أسس لمحاولة تعريف المقاتل، فكان لابد من اقرار التفرقة بين المقاتلين أنفسهم وتقسيمهم إلى فئتين، إذ هناك فئة مقاتلة تندرج ضمن فئة المقاتلين الشرعيين، الذي جاء نتيجة التنظيم المتميز به، كما يضفى عليه صفة أسير الحرب التي تمكنه من التمتع بمجموعة من الحقوق، وعليه واجبات يلتزم بها في النزاعات المسلحة.
