Abstract

الملخص: يمكننا القول بأن المجتمع والنظام السياسي والإداري في الدولة قد بلغ فعلا رشده من الناحية القانونية والسياسية. ليحل نظام الإخطار أو التصريح المسبق المقترن بحق السلطة الإدارية في الاعتراض، ثم غير المقترن بهذا الحق لاحقا محل نظام الترخيص الإداري المسبق مثلما حدث ويحدث بالنسبة لبعض الحريات في كثير من الدول العريقة في الديمقراطية، كحرية الصحافة وحرية الاجتماع وحرية التجمع، هاتان الأخيرتان اللتان شهدت ممارستهما تقهقرا وتراجعا من قبل المشرع الجزائري مع بداية التسعينات عند تنظيمه لهما، وهما كما هو معلوم من الحريات القديمة والعريقة في المجتمعات.

Résumé : Nous pouvons dire que la sociétéet le systèmepolitique et administratif de l’Étatont déjà atteintleursensjuridique et politique.
