Il s'agit d'un fonds commun de droit de tous les associés réunis à moins qu'il n'y ait un accord contraire, de sorte que personne ne devrait agir seul, sinon il serait considéré comme violant les droits des autres associés. La division des tâches est l'illustration parfaite de ce principe, le législateur accordant à ceux qui détiennent la majorité du capital social le pouvoir de gestion. Quant aux dépenses de conservation et d'entretien, le législateur a accordé le droit à celui qui les assume seul, tandis que tous les associés supportent les dépenses selon leur part dans l'argent commun. Abstract: This topic discusses the common financial management method, in which the partners aim for the proper utilization and benefit of this money, sharing its fruits among themselves. It constitutes a common fund by right of all the partners collectively unless there is an agreement to the contrary, so that no one should act alone, otherwise, they would be considered as infringing upon the rights of the other partners. The division of tasks is the ideal illustration of this principle, with the legislator granting those who hold the majority of the shared capital the authority to carry out management tasks. As for the expenses of conservation and maintenance, the legislator has granted the right to those who undertake them alone, while all partners bear the expenses according to their share of the money.
