    صلاحيات الوزير الأول في الجزائر

    تناولت هذه الدراسة صلاحيات الوزير الأول في الجزائر عبر تتبع تطور مركزه الدستوري والقانوني في ظل مختلف الدساتير الجزائرية. وقد أظهرت الدراسة أن الوزير الأول، في ظل دستوري 1963 و1976، كان يتمتع بصلاحيات محدودة نتيجة هيمنة رئيس الجمهورية على السلطة التنفيذية، في حين شهد هذا المنصب تطوراً ملحوظاً بعد دستور 1989 مع تبني التعددية السياسية وثنائية السلطة التنفيذية. كما بينت الدراسة أن التعديلات الدستورية اللاحقة ساهمت في تعزيز الدور التنسيقي والإداري للوزير الأول، رغم احتفاظ رئيس الجمهورية بمعظم الصلاحيات الجوهرية ضمن النظام السياسي الجزائري. وخلصت الدراسة إلى أن النظام السياسي الجزائري لا يزال يقترب من النظام الرئاسي، مع الإشارة إلى أهمية تعزيز استقلالية الوزير الأول وتحقيق توازن أكبر داخل السلطة التنفيذية. Abstract: This study examines the powers of the Prime Minister in Algeria by tracing the evolution of his constitutional and legal status under various Algerian constitutions. The study reveals that, under the 1963 and 1976 constitutions, the Prime Minister possessed limited powers due to the President's dominance over the executive branch. However, this position underwent significant development after the 1989 constitution with the adoption of political pluralism and a dual executive. The study also demonstrates that subsequent constitutional amendments have strengthened the Prime Minister's coordinating and administrative role, despite the President retaining most of the essential powers within the Algerian political system. The study concludes that the Algerian political system is still moving towards a presidential system, while emphasizing the importance of enhancing the Prime Minister's independence and achieving greater balance within the executive branch.

    ملخص يعد الوزیر الأول الرئیس الإداري الأعلى في جهاز الحكومة باعتباره المسیر والمشرف على العمل الإداري داخل هذا الجهاز وتظهر العلاقة بین الوزیر الأول و رئیس الجمهوریة من خلال تعیین هذا الأخیر للوزیر الأول وإنهاء مهامه كما أن الوزیر الأول مسئول أمام المجلس الشعبي الوطني من خلال عرض مخطط عمل الحكومة و بمناسبة مناقشة بیان السیاسة العامة. وخلاصة القول نستنتج أن الوزیر الأول رغم نص الدستور على بعض الاختصاصات المنفردة للوزیر الأول إلا انه یعتبر مستقل استقلالیة نسبیة عن رئیس الجمهوریة ویعتبر أداة في ید هدا الأخیر لتنفیذ سیاسته. Résumé Le premier ministre est le chef administratif suprême de l'appareil gouvernemental en tant que superviseur des travaux administratifs au sein de cet organe. La relation entre le premier ministre et le président est indiquée par la nomination de ce dernier au premier ministre et la cessation de ses fonctions. Le premier ministre est responsable devant l'Assemblée populaire nationale en présentant le plan d'action du gouvernement Et à l'occasion de la discussion de la déclaration de politique. L'essentiel est que le premier ministre, malgré les stipulations de la constitution sur certains de ses mandats, soit indépendant de l'indépendance du président et soit considéré comme un outil entre ses mains pour mettre en œuvre sa politique. Abstract The first minister is the supreme administrative head of the government apparatus as the supervisor of administrative work within this body. The relationship between the first minister and the president is indicated by appointing the latter to the first minister and ending his duties. The first minister is accountable to the National People's Assembly by presenting the government's plan of action and on the occasion of the discussion of the policy statement. The bottom line is that the first minister, despite the constitution's stipulation on some of the terms of reference of the first minister, is independent of the president's independence and is considered a tool in the latter's hands to implement his policy.
