Item دور النيابة العامة في قضايا شؤون الأسرة(University Centre of Maghnia, 2022-02-14) بوعزي مصطفىالملخص: النيابة العامة تعتبر الأداة الفعالة للسهر على احترام القانون وحماية النظام العام والدفاع عن المجتمع، وقد سعي المشرع لتعزيز دورها في قضايا الأسرة وذلك بسنه للمادة 03 مكرر، من خلالها مُكنت من أن تكون طرفا أصليا في جميع الدعاوى الرامية إلى تطبيق أحكام قانون الأسرة، إلا انه وفي غياب الأدوات الإجرائية الموضحة للدور المنوط بها من جهة وفي غياب الاجتهاد القضائي من جهة ثانية يظل دورها غير مستساغ من الناحية الفقهية يشوبه الغموض من الناحية العملية. Résumé : Le parquet général considéré comme l'outil efficace pour assurer le respect de la loi, protéger l'ordre public et défendre la société. Le législateur a cherché à renforcer son rôle dans les questions familiales en promulguant l'article 03 bis par lequel il lui permettait d'être partie prenante dans toutes les affaires visant à mettre en œuvre les dispositions de la loi sur la famille, mais en l'absence d'outils procéduraux La clarification du rôle qui lui est assigné d'une part, et en l'absence de jurisprudence judiciaire d'autre part, son rôle reste désagréable d'un point de vue jurisprudentiel teinté d'ambiguïté dans la pratique. Summary : The Public Prosecution is considered the effective tool to ensure respect for the law, protect public order and defend society. The legislator sought to enhance its role in family issues by enacting Article 03 bis through which it enabled it to be a principal party in all cases aimed at implementing the provisions of the Family Law, but in the absence of procedural tools The clarification of the role assigned to it on the one hand, and in the absence of judicial jurisprudence on the other hand, its role remains unpalatable from a jurisprudential point of view tinged with ambiguity in practice.
