Le législateur en a fait un outil important, dans les mains de l'autorité publique, pour la réalisation des opérations financières, la gestion et l’exploitation des services publics. La relation directe existant entre les marchés publics et les fonds publics, expose ce domaine à diverses formes de corruption et de manipulation de sorte qu'il est devenu nécessaire de les soumettre à des mécanismes de contrôle administratifs et judiciaires efficaces.
