    ملخص: يكفل تمتع الإدارة بامتيازات السلطة العامة حق تنفيذ قراراتها ، فإن من شأن ذلك أن يؤثر على حقوق وحريات الأفراد وبالتالي إلحاق ضرر بهم ، وهو ما يترتب للشخص المضرور الحق في التعويض سواء أكان الضرر اللاحق به نتج عن عمل إداري مشروع أو غير مشروع ، على أساس المسؤولية الإدارية بخطأ ، أو المسؤولية الإدارية بدون خطأ ، وذلك من خلال رفع دعوى أمام القضاء الإداري تسمى دعوى التعويض الإدارية والتي تهدف إلى المطالبة بالتعويض وجبر الأضرار اللاحقة بالمضرور .
