    ن الصفقات العمومية بإعتبارها قناة هامة و حساسة لإستعمال المال العام وإنفاقه ودفع العجلة الإقتصادية في البلد وأكبر مجال حيوي للفساد،كان من الضروري إحاطتها بآلية رقابة داخلية تتشكل أساسا في لجنة فتح الأظرفة وتقييم العروض، حرصا من المشرع الجزائري على تحقيق منفعة عامة أكبر و بأقل تكلفة و في إطار تجسيد الشفافية وتكريس مبدأ المساواة بين المتعاملين وحماية المال العام من التبديد والضياع. Résumé Les marchés publics en tant que canal important et sensible pour l'utilisation et la dépense des fonds publics, le développement de la roue économique du pays et le plus vital secteur de la corruption, il était nécessaire d’imposer un mécanisme de contrôle interne exécuté par la commission d’ouverture des plis et d’évaluation des offres, dont l'intérêt du législateur algérien d'obtenir un plus grand bénéfice public au plus bas coût dans le cadre de l'incarnation de la transparence, de la mise en place du principe d'égalité et la protection des fonds publics. Abstract Public procurement as an important and sensitive channel for the use and expenditure of public funds, the development of the country's economic wheel and the most vital sector of corruption, it was necessary to impose an internal control mechanism executed by the bid opening and bid evaluation commission, whose interest the Algerian legislator has to obtain a greater public benefit at the lowest cost as part of the incarnation of transparency, the establishment of the principle of equality and the protection of public funds.

    الأوامر التشريعية في ظل التعديل الدستوري الجزائري 2020

    الملخص اشترك رئيس الجمهورية مع البرلمان في الاختصاص التشريعي من خلال آلية التشريع بأوامر المخولة لرئيس الجمهورية بموجب جميع الدساتير الجزائرية المتعاقبة ، إلا دستور 1989 ونظرا للمجال الواسع للتشريع بأوامر لرئيس الجمهورية جاء التعديل الدستوري سنة 2020 للحد من تدخل رئيس الجمهورية في السلطة التشريعية ، من خلال فرض مجموعة من الضوابط الموضوعية والشكلية للحد من هذا التدخل حيث أضاف كذلك الرقابة القضائية على الأوامر التشريعية عن طريق هيئة قضائية متمثلة في المحكمة الدستورية . Résume : Le Président de la République a partagé avec le Parlement la compétence législative à travers le mécanisme de la législation par ordonnances accordées au Président de la République selon toutes les constitutions algériennes successives, à l'exception de la Constitution de 1989. Parmi les contrôles de fond et de forme pour limiter cette ingérence, comme il a également ajouté un contrôle judiciaire sur les ordonnances législatives par le biais d'un organe judiciaire représenté par la Cour constitutionnelle. Abstract : The President of the Republic shared with Parliament in legislative competence through the mechanism of legislation by orders granted to the President of the Republic according to all successive Algerian constitutions, except for the 1989 Constitution. Among the substantive and formal controls to limit this interference, as he also added judicial oversight on legislative orders through a judicial body represented by the Constitutional Court.
