Item عنوان المذكرة: الوكيل الذكي للمرحلة التحضيرية للصفقات العمومية(University Centre of Maghnia, 2024-07-04) طاهر نور الهدى - بلعروسي حورية -حامد فاطمةالملخص: تعد الصفقات العمومية من أهم العقود التي تعرف مرحلة تكوينها تأطيرا قانونيا مكثفا، فتكوين الصفقات العمومية يتضمن عملية بالغة في الأهمية وهي المرحلة السابقة على التعاقد. لهذا وضع لها المشرع آليات وإجراءات متعددة وطويلة، فصلاح المرحلة الأولى لأبرام الصفقة العمومية الا وهي اعداد دفتر الشروط من قبل المصلحة المتعاقدة يؤدي الى اصلاح ونجاعة الصفقة العمومية بالتالي يتحقق السير الحسن للمرفق العام وترشيد المال العام. ولتحقيق ذلك حاولنا من خلال دراستنا ابراز دور الذكاء الاصطناعي في تطوير أساليب تحضير الصفقة العمومية من خلال اعداد منصة الكترونية تنظم ذلك. Résumé Les marchés publics font partie des contrats les plus importants dont l'étape de l’élaboration est soumise à un encadrement juridique approfondi. L’élaboration des marchés publics comprend un processus très important, qui est l'étape précédant le contrat. Pour cette raison, le législateur a établi des mécanismes et des procédures multiples et longs. La régularité de la première étape de la conclusion du marché public, qui est l'élaboration du cahier des charges par le pouvoir adjudicateur, conduit à la réforme et à l'efficacité du marché. Contrat public, permettant ainsi le bon fonctionnement du service public et la rationalisation des fonds publics. Pour y parvenir, nous avons tenté à travers notre étude de mettre en évidence le rôle de l’intelligence artificielle dans l’élaboration des méthodes de préparation de la transaction publique en préparant une plateforme électronique qui organise celle-ci. Abstract: Public procurement contracts are one of the most important contracts that undergo an intensive legal formalization process during their formation phase. The formation of public procurement contracts involves an extremely important process, which is the pre-contractual phase. This is why the legislator has put in place multiple and lengthy procedures, including the preparation of the specifications by the contracting authority, which leads to the improvement and efficiency of the public procurement contract, and consequently to the good management of the public service and the rationalization of public finances. To achieve this, we have tried in our study to highlight the role of artificial intelligence in the development of methods for preparing public procurement contracts through the implementation of an electronic platform that organizes this.
