The Act confers upon the public administration powers and powers to issue such administrative acts as it wishes in the public interest, within the framework of respect for the principle of legality, and to ensure that the Department's actions conform to this principle. The administrative judiciary has allowed the Department's responsibility for its unlawful administrative actions to be established in order to protect the rights and freedoms of individuals, so that this responsibility is based on the annexed error, which determines the right of the injured to compensation in accordance with special rules and provisions. La Loi confère à l’administration publique le pouvoir et les pouvoirs d’émettre les actes administratifs qu’elle souhaite dans l’intérêt public, dans le cadre du respect du principe de légalité, et de veiller à ce que les actions du Ministère soient conformes à ce principe. La magistrature administrative a autorisé l’établissement de la responsabilité du Ministère pour ses actions administratives illégales afin de protéger les droits et libertés des personnes, de sorte que cette responsabilité soit fondée sur l’erreur ci-jointe, qui détermine le droit du blessé à une indemnisation conformément à des règles et dispositions spéciales.
