Item حماية المدنيين في النزاعات المسلحة(2018) بن مغني, أيوبالملخــص: يتناول هذا البحث موضوع حماية المدنيين أثناء النزاعات المسلحة، الذي يدخل في إطار القانون الدولي الانساني، و هو قانون حديث النشأة يتضمن القواعد القانونية التي تحمي الأشخاص الذين لا يشاركون في القتال ، و نقصد بهم على وجه الخصوص المدنيين، حيث يضع قيودا على المقاتلين في استخدام القوة العسكرية ويلزم القادة العسكرين بالتقيد ببعض القواعد المتصلة بأسليب القتال . و قد استند موضوع دراستنا على مجموعة من الاتفاقيات التي تناولت موضوع حماية المدنيين اثناء النزاعات المسلحة ، و هي أتفاقية جنيف الرابعة لعام 1949م، بشأن حماية المدنيين زمن الحرب ، و البروتوكليين الاضافيين لعام 1977م . الأول خاص بالنزاعات المسلحة ن و الثاني خاص بالنزاعات المسلحة الدولية. و لهذا فإن دراستنا هي محاولة لتسليط الضوء على النصوص القانونية المقررة في الاتفاقيات الدولية السالفة الذكر. كما ركزنا على أهم الآليات الدولية المكرسة لتنفيذ قواعد الحماية المقررة لحماية المدنيين اثناء النزاعات المسلحة . Résumé: Cette étude porte sur la protection des civils dans les conflits armés, qui s'inscrit dans le cadre du droit international humanitaire, une loi nouvellement créée qui contient les règles juridiques qui protègent les personnes qui ne participent pas aux hostilités, et en particulier les civils. Force militaire Les commandants militaires sont tenus de respecter certaines règles relatives à l'épée des combats. Le sujet de notre étude était basé sur une série de conventions traitant de la protection des civils pendant les conflits armés, à savoir la Quatrième Convention de Genève de 1949 sur la protection des civils en temps de guerre et les Protocoles additionnels de 1977. L'un pour les conflits armés et l'autre pour les conflits armés internationaux. Par conséquent, notre étude est une tentative de mettre en évidence les textes juridiques établis dans les conventions internationales mentionnées ci-dessus. Nous nous sommes également concentrés sur les mécanismes internationaux les plus importants consacrés à la mise en œuvre des règles de protection établies pour la protection des civils en période de conflit armé Summary : This study deals with the protection of civilians in armed conflict, which falls within the framework of international humanitarian law. It is a newly created law that contains the legal rules that protect persons who do not participate in hostilities, and in particular civilians. Military force Military commanders are required to abide by some rules relating to the sword of fighting. The subject of our study was based on a series of conventions dealing with the protection of civilians during armed conflict, namely, the Fourth Geneva Convention of 1949, on the Protection of Civilians in Time of War, and the Additional Protocols of 1977. One for armed conflicts and the other for international armed conflicts. Therefore, our study is an attempt to highlight the legal texts established in the international conventions mentioned above. Résume : Cette recherche porte sur le thème de la protection des civils pendant les conflits armés, qui entre dans le cadre du droit international humanitaire, les civils sont les plus grandes victimes est pris en compte dans le temps de la guerre où il a abordé la droit international humanitaire, la durée des civils dans de nombreux accords internationaux où impose des restrictions aux combattants dans l'utilisation de la force militaire et les commandants militaires tenus de se conformer certaines des règles relatives aux méthodes de lutte contre les conflits armés, qui est l'une des guerres les plus dangereuses. La communauté internationale a réalisé des mesures décisives pour protéger les civils en temps de conflit armé interne ou international, qui ont laissé des conséquences graves pour l'ensemble de l'humanité, et dans l'étude Notre sujet sur un groupe de conventions internationales relatives à la protection des civils pendant les conflits armés, à savoir la quatrième Convention de Genève de 1949 sur la protection des civils en temps de guerre, et les Protocoles additionnels de 1977.
