جريمة إختطاف الأطفال في قانون العقوبات الجزائري

Abstract

الملخص: يعرف المجتمع الجزائري ظاهرة غريبة و هذا خلال السنوات الأخيرة، و هي خارجة عن عاداته و تقاليده و هي جريمة إختطاف الاطفال، حيث أضحت تؤرق جل العائلات، كما زرعت الخوف في نفوس الأبناء، إن هذه الظاهرة تعرف تناميا متصاعدا في ظل إنتشار وسائل التواصل الإجتماعية مما خلق ضغطا كبيرا على الدولة بصفة عامة امام إرتفاع أصوات الجمعيات المدنية و الرأي العام على ضرورة تدخل الدولة للضرب بيد من حديد لكبح إنتشار هذه الجريمة، حيث قام المشرع الجزائري بسن قانون خاص لمكافحة جريمة إختطاف الأشخاص، مع تشديد العقوبات الموقعة على الجناة. Résumé : La société algérienne connait un phénomène étrange au cours dernières années ; sortant de ses coutumes et tradition : le crime d’enlèvement d’ enfants. Il a commencé à tourmenter la plupart des familles et semer la peur chez les enfants. Cette tendance croissant est attribuée à la prolifération des médias sociaux. Exerçant ainsi une pression considérable sur l’état pour répondre aux appels des associations civiles et de l’opinion publique en faveur d’une intervention ferme pour enrayer cette criminalité. En réponse le législateur algérien a promulgué une loi spéciale pour lutter contre ce crime. Avec des sanctions plus sévères pour les coupables.

Summary: Algerian society knows a strange phenomenon، and this has occurred in recent years، and it is outside its customs and traditions، which is the crime of kidnapping children، as it has become a problem for most families، and has also planted fear in the hearts of children. This phenomenon is witnessing an increasing growth in light of the spread of social media، which It created great pressure on the state in general in the face of the rising voices of civil society organizations and public opinion on the need for the state to intervene to strike with an iron hand to curb the spread of this crime، as the Algerian legislator enacted a special law to combat the crime of kidnapping people، while tightening the penalties imposed on the perpetrators.
