دور التحكيم الالكتروني في ظل تطور التجارة الالكترونية

Abstract

الملخص: يحظى التحكيم الإلكتروني بأهمية بالغة وفعالة في حل النزاعات وخاصة تلك الناجمة عن التجارة الالكترونية ويوفر هذا الأسلوب العديد من المزايا التي لا يوفرها أي نظام قانوني لحسم المنازعات ومن بينها السرعة وقلة التكاليف نظرا لاستيعابه الخصائص التي تتميز بها بيئة التجارة الالكترونية إضافة الى كونه أكثر الزاما من التحكيم التقليدي من خلال اعتماده على اليات خاصة تمكنه من تنفيذ احكامه الصادرة بعيدا عن القضاء الوطني. Abstract: Electronic arbitration is extremely important and effective in resolving disputes arising from electronic commerce. This method offers many advantages that no legal dispute resolution system offers, including speed and low costs because it absorbs the characteristics that characterize the electronic commerce environment, in addition to being more binding than arbitration traditional by relying on special mechanisms that allow it to be implemented outside the national the judicial system.

Résumé : L’arbitrage électronique est extrêmement important et efficace pour résoudre les litiges résultant du commerce électronique. Cette méthode offre de nombreux avantages qu’aucun système juridique de résolution des litiges n’offre, notamment la rapidité et les faibles couts car il absorbe les caractéristiques qui caractérisent l’environnement du commerce électronique, en plus d’être plus contraignant que l’arbitrage traditionnel en s’appuyant sur des mécanismes spéciaux qui lui permettent d’être mis en œuvre en dehors du système judiciaire national.
