صلاحيات الحكومة في ظل التعديل الدستوري لسنة 2020

Abstract

ملخص: إن التعديل الدستوري الجزائري لسنة 2020 جاء بالعديد من المستجدات من ناحية مكانة وصلاحيات الحكومة، فقد تم إنشاء منصبين من اجل قيادة الحكومة:( وزير أول أو رئيس الحكومة حسب الحالة ) وذلك حسب نتيجة الانتخابات التشريعية.بالرغم من هذا التعديل فقد أبقى المؤسس الدستوري الجزائري على فكرة هيمنة رئيس الجمهورية على الحكومة ورئاستها.كما سلطت هذه الدراسة الضوء على الصلاحيات الحصرية لقائد الحكومة، والتعاون القائم ما بين قائد الحكومة وكل من رئيس الجمهورية والبرلمان. Résumé : L’amendement constitutionnel algérien de 2020 a apporté plusieurs modifications à la structure et aux pouvoirs du gouvernement algérien, cet amendement a crée deux postes : (premier ministre ou chef du gouvernement selon le cas) d’après les résultats des élections législatives .Malgré ce dernier amendement. Le fondateur de la constitution algérien a préservé l’idée de la domination du président de la république. Cette étude contribué à souligner l’importance sur les pouvoirs exclusifs de (premier ministre ou chef du gouvernement selon le cas), et la coopération entre ce dernier, le président de la république, et le parlement. Summary : The algerian constitutional amendment of 2020 brought several changes to the structure and powers of the algerian government. In this amendment two positions were created (prime minister or head of government depending on the situation ), based on the results of the legislative elections. Despite this last constitutional amendment, the algerien constitutional founder has protected the idea of the dominance of the president of the republic. This study has shed light on the exclusif powers and cooperative relationship among the leader of the gouvernment, the president of the republic, and the parliament.
