الحماية القانونية للطفل من الاستغلال الاقتصادي

Abstract

ملخص : تعد مسألة تشغيل الأطفال من أهم المسائل التي شغلت الرأي العام بمختلف أطيافه نظرا لانعكاساتها السلبية على عملية التنمية، واستقرار المجتمعات، ولهذا كان الهدف من هذه الدراسة هو البحث في الحماية القانونية للطفل من الاستغلال الاقتصادي على المستوى الدولي من خلال الجهود التي بذلها المجتمع الدولي لمكافحة هذه الظاهرة عن طريق إبرام مجموعة من الصكوك الدولية، بحيث تعد منظمة العمل الدولية من بين المنظمات الرائدة في هذا المجال، وعلى المستوى الوطني من خلال دراسة الضوابط التي وضعها المشرع الجزائري لمواجهة الاستغلال الاقتصادي للطفل، والتي كانت مستوحاة من اتفاقية حقوق الطفل 1989. Abstract: Child labour is one of the most important issues that preoccupied public opinion in its various sects due to its negative repercussions on the development process, and stability of societies, the purpose of this study was therefore to investigate the legal protection of the child economic exploitation at the international level through the international community’s efforts to combat this phenomenon by concluding a series of international instruments, ill is one of the leading organizations in this area, at the national level, through an examination of the regulations established by Algerian legislation to counter exploitation economic of the child, which was inspired by the convention on the right of the child of 1989. Résumé : Le travail des enfant est lune des questions les plus importantes de l’opinion publique compte tenu de ses implications négatives pour le processus de développement et la stabilité des sociétés, le but de cette étude était donc d’étudier la protection juridique des enfants contre l’exploitation économique au niveau international a la travers les efforts de la communauté internationale pour lutter contre ce phénomène en concluant une série d’instruments internationaux loit est lune des principales organisations dans ce domaine, au niveau national, par un exam des réglementations établies par la législation algérienne pour lutter contre l’exploitation économique de l’enfant qui s’inspire de la convention relative aux droits de l’enfant 1989.
