Abstract

الملخص: يمثل مبدأ تسبيب القرارات الإدارية من بين المبادئ العامة للنظام العام القانوني اللازم لصحة القرار الإداري وسلامته، وذلك من خلال إلزام الإدارة بذكر الأسباب القانونية و الواقعية التي حملتها على إصداره، إذ عملت الكثير من الدول القانونية على تكريسه في منظوماتها القانونية، وتجسيده على أرض الواقع نظرا للدور الذي يساهم به في حماية حقوق وحريات الأشخاص من تعسف الإدارة، إذ يساهم في تعزيز المشروعية داخل الدولة، من خلال مساهمته في فعالية الرقابة الذاتية و القضائية للإدارة على قراراتها. Résumé : le principe de causalité des décisions administratives fait partie des principes généraux de l’ordre judiciaire général nécessaire à la bonne décision administrative et son intégralité, a travers l’obligation de l’administration a mentionner les raisons légales et réaliste qui l’ont amenée à l’émettre, comme de nombreux pays qui se sont efforcés a le consacrer dans leurs système juridique, et de l’appliquer sur le terrain en raison du rôle qui contribue à la protection des droits et des libertés des citoyens contre l’abus de l’administration. Summary : The principle of causality of administrative decisions is part of the general judicial order necessary for a good administrative decision and its entirety through the obligation of the administration to mention the legal and realistic reasons which led it to the decision. Issue like many countries which have endeavoured to enshrine it in their legal system, and to apply it in the field because of the role which contributes to the protection of the right and freedoms of citizens against abuse of the administration.
