الأقطاب الجزائية المتخصصة المستحدثة في التشريع الجزائري

Abstract

ملخص: تبنى المشرع نظام الأقطاب الجزائية المتخصصة بموجب القانون 04-14 المؤرخ في 10 نوفمبر 2004، لمكافحة الأنماط المستحدثة للجرائم والحد من انتشارها، إذ تتميز هذه الأقطاب باختصاصها الإقليمي الموسع في نوع معين من الجرائم والتي حددها قانون الإجراءات الجزائية، كما استحدث القطب الجزائي الاقتصادي والمالي، والقطب الجزائي الوطني لمكافحة الجرائم المتصلة بتكنولوجيا الاعلام والاتصال ووسع من اختصاصهما ليشمل كافة المحاكم والجهات القضائية على المستوى الوطني. كما تعتمد الأقطاب الجزائية طرق استثنائية ومستحدثة للبحث والتحري عندما يتعلق الأمر بالجرائم المستجدة المذكورة في قانون الإجراءات الجزائية، هذا وخول القانون للنائب العام صلاحية المطالبة بالإجراءات على مستوى المجلس القضائي التابع له القطب الجزائي، والذي يعتبر أهم إجراء من أجل تحريك الدعوى العمومية أمام الأقطاب الجزائية المتخصصة.

Résumé Le législateur a adopté le système des poles pénaux spécialisés prévus par la loi 14-04 du 10 novembre 2004, pour lutter contre les schémas émergents de délinquance et limiter leur propagation. Le tribunal pénale national pour lutter contre les délits lié aux technologies de l’information et de la communication et a élargi sa compétence à tous les tribunaux et autorités judiciaires au niveau national. Les poles pénaux adoptent également des méthodes de recherche et d’investigation exceptionnelles et innovantes en ce qui concerne les infractions émergentes mentionnées dans le code de procédure pénale.

Summary the legislator adopted the system of specialized penal poles under law 14-04 of November 10,2004 to combat the emerging patterns of crimes and limit their spread. The national criminal court to combat crimes related to information and communication technology and expanded their jurisdiction to include all courts and judicial authorities at the national level. The criminal poles also adopt exceptional and innovative methods of research when it comes to emerging crimes mentioned in the code of criminal procedure.
