Abstract

الملخص: يستهدف البحث تحليل نطاق سلطة الإدارة التقديرية في صياغة القرارات الإدارية الإلكترونية، حيث ترتكز أهميتها على تحقيق العدالة والمساواة في تقديم الخدمات العامة. تمنح قوانين الإدارة سلطات واسعة لضمان فعالية أدائها، مما يؤدي إلى تحقيق التوازن في الخدمات التي تقدم للمواطنين. بفعل التطور العلمي والتكنولوجي، حيث تحولت الحكومات إلى حكومات إلكترونية، لكن الإدارة تظل المحرك الرئيسي لهذا التحول. ومن هنا، يظل دراسة نطاق سلطتها في صياغة القرارات الإلكترونية أمرًا ذو أهمية بالغة لضمان سلامة وفعالية العمليات الإدارية الحديثة. Résumé : étude vise à analyser le champ de compétence du pouvoir discrétionnaire dans la formulation des décisions administratives électroniques, où son importance repose sur la réalisation de la justice et de l'égalité dans la prestation des services publics. Les lois confèrent à l'administration des pouvoirs étendus pour garantir l'efficacité de son fonctionnement, ce qui permet d'atteindre un équilibre dans les services fournis aux citoyens. En raison de l'évolution scientifique et technologique, les gouvernements sont devenus des gouvernements électroniques, mais l'administration reste le moteur principal de cette transition. Ainsi, l'étude du champ de sa compétence dans la formulation des décisions électroniques demeure d'une importance capitale pour garantir la sécurité et l'efficacité des opérations administratives modernes. The research aims to analyze the scope of discretionary authority in formulating electronic administrative decisions, where its importance lies in achieving justice and equality in the provision of public services. Laws grant administrations broad powers to ensure the effectiveness of their performance, leading to a balance in the services provided to citizens. Due to scientific and technological advancements, governments have transitioned into electronic governments, yet administration remains the primary driver of this transition. Hence, studying the scope of its authority in formulating electronic decisions remains of utmost importance to ensure the safety and effectiveness of modern administrative operations.
