أثر عمل المحكمة الدستورية على حماية الحقوق والحريات العامة

Abstract

الملخص: لقد أنشأ المؤسس الدستوري المحكمة الدستورية كهيئة رقابية مستقلّة مكلّفة بمهمّة الرقابة على دستورية القوانين التي أصبحت نوعان رقابة سابقة (وجوبية جوازية)، ورقابة لاحقة (جوازية)، كما أنّ المحكمة الدستورية تفصل بقرار في رقابة المطابقة ورقابة الدستورية وآلية الدفع بعدم الدستورية وتبيان مسؤوليتها في ضمان الحقوق والحريات الدستورية، ممّا يعزّز مكانتها في النظام الدستوري الجزائري فهي تكرّس التّوازن بين السّلطات، وتضمن استمرارية مؤسّسات الدولة. Résumé: Le fondateur constitutionnel a créé la Cour constitutionnelle en tant qu'organe de contrôle indépendant, chargé de la mission de vérifier la constitutionnalité des lois. Cette vérification a pris deux formes : le contrôle a priori (obligatoire et facultatif) et le contrôle a posteriori (facultatif). La Cour constitutionnelle rend une décision sur le contrôle de la conformité, le contrôle de la constitutionnalité et le mécanisme de l'exception d'inconstitutionnalité, en précisant son rôle dans la protection des droits et libertés constitutionnels. Cela renforce sa position dans le système constitutionnel algérien, car elle consacre l'équilibre entre les pouvoirs et garantit la continuité des institutions de l'État. Abstract : The constitutional founder established the Constitutional Court as an independent oversight body tasked with monitoring the constitutionality of laws. This oversight has two forms: a priori control (mandatory and discretionary) and a posteriori control (discretionary). The Constitutional Court issues a ruling on the conformity control, constitutionality control, and the mechanism of the plea of unconstitutionality, outlining its role in protecting constitutional rights and freedoms. This strengthens its position within the Algerian constitutional system, as it upholds the balance of powers and ensures the continuity of state institutions.
