الرقابة القضائية على مشروعية الأعمال الإدارية

Abstract

ملخص: إن الرقابة القضائية تتمز بالحياد وموضوعية واستقلالية لذلك تعد من أهم صور الرقابة على أعمال الإدارة، حيث يراقب هيئة الضبط الإداري في الظروف العادية والاستثنائية إذ يعتبر القضاء أكثر الأجهزة القادرة على حماية مبدأ الشرعية وحقوق وحريات الأشخاص من تعسف الإدارة. Résumé : Le contrôle judiciaire se caractérise par l'impartialité, l'objectivité et l'indépendance il s'agit donc de l'une des formes les plus importantes de contrôle du travail de l'administration. Ce contrôle administratif est assuré dans les circonstances normales et exceptionnelles car le pouvoir judiciaire est l'organisme le plus habilité à protéger le principe de la légitimité et les droits et liberté des personnes de l'abus d'autorité de l'administration. Summary: Judicial oversight is characterized by impartiality, objectivity and independence. Therefore, it is considered one of the most important forms of oversight over the work of the administration, as the administrative control body monitors in normal and exceptional circumstances, as the judge is considered the most capable of the principle of legitimacy and the rights and freedoms of persons from the arbitrariness of the administration.
