Abstract

الملخص: تتناول هذه الدراسة البحثية مرحلة مؤقتة في مسار الوظيفة العمومية ، وتتمثل هذه المرحلة فيما يصطلح عليه المشرع الجزائري بفترة التربص، باعتبارها كقاعدة عامة، مرحلة ضرورية بالنسبة لكل شخص مُعين حديث التوظيف، إذ يجب عليه قضاء فترة تربص إجبارية لمدة زمنية محددة، تسري ابتداءً من تاريخ تعينيه في الرتبة والوظيفة المطلوب شغلهما؛ فيأخذ المركز القانوني للشخص في هذه الفترة صفة المتربص؛ هذا الأخير لم يحض باهتمام كبير في التشريع الجزائري للوظيفة العمومية، إلا في الآونة الأخيرة، وذلك ابتداءً من تاريخ 02 نوفمبر سنة 2017 ، حيث أسفر عن هذا التاريخ صدور لأول مرة تنظيم قانوني خاص بالأحكام المطبقة على المتربص في المؤسسات والإدارات العمومية. Résume : Cette étude porte sur l’étape temporaire dans l'exercice de la fonction publique. Cette étape est définie par le législateur algérien comme période de stage . Elle est, en règle générale, une étape nécessaire pour toute personne nouvellement nommée qui doit passer une période de stage obligatoire pour une période spécifique, à compter de la date de nomination au grade et au poste à pourvoir. Pendant cette période, le statut juridique de la personne prend le statut de stagiaire. Ce dernier n'a pas reçu beaucoup d'attention dans la législation algérienne pour la fonction publique, sauf ces derniers temps, à compter de la date du 02 novembre 2017. Cette date ayant pour la première fois donné lieu à la promulgation d'un règlement juridique pour les dispositions applicables à l'apprenti dans les institutions et services publics. Abstract: This research paper discusses a temporary stage in the course of public service, whether at the level of central administrations, decentralized administrations or institutions of administrative nature،This stage is designated by the Algerian legislator as the "probationary period," which, as a general rule, is considered a necessary stage for every newly hired employee.During this stage, each newly hired employee must spend a period of compulsory probation for a specified period of time, which commences from the date of appointment in therank and position to be filled.The legal status of this employee, during this period, is described as "employee on probation." . This latter has not received significant attention in the Algerian legislation for public service until only recently, particularly as of 02 November 2017.This date marked the promulgation of the first legal regulation of provisions applicable to the employee on probation in public institutions and administrations.
