الحقوق المادية للمرأة المطلقة والطفل المحضون في ظل قانون 15-01

Abstract

ملخص الدراسة : تشكل النفقة المحكوم بها قضاء لصالح المطلقة وأولاها بعد الطلاق التزاما أساسيا على عاتق الزوج حفاظا على كرامتهم وصونا لعرضهم.إلا أنه توجد إشكالات قضائية كثيرة في التنفيذ إما لعسر الزوج الملزم بالنفقة وٕإما عدم وجود أموال ظاهرة للحجز عليها وإما لعدم معرفة مكانه . وحماية للمرأة المطلقة وصونا لها من المعانات أعطى المشرع الجزائري حقوقا مالية للمطلقة الحاضنة ومحضونها لحمايتهم من التشتت والضياع ،حيث تدخل بالقانون رقم 15-01 المتضمن إنشاء صندوق خاص بالنفقة ،الذي حدد فيه المستفيد من النفقة في الطفل المشمول بالحضانة والمرأة المطلقة، وعلى الدائن بالنفقة أن تتوفر فيه شروط الحصول عليها ليقوم بعدها بالإجراءات القانونية الواجبة.

Résume La pension alimentaire accorée par le juge à la femme divorcé et les enfants constitue une obligation fondamentale de l’époux afin de préserver leur dignité et leur honneur, mais il y a plusieurs problème judiciaire dans la mise en œuvre soit l’impuissance du mari dans l’obligation d’exercés soit a cause de l’absence de l'argent pour être réservée ou pour ne pas connaître sa place. Pour cela, le législateur algérien, est intervenu en mettent en place un fond spécial pour la pension alimentaire à travers la loi 01-15 Cette dernière a précisé le bénéficiaire de la pension (l’enfant sous la garde et la femme divorcée) et les conditions qui doit remplir le créancier de ce fond.

Summary Alimony is a fundamental pledge that the husband has to undertake in order to protect his children and former wife’s dignity and honour,However , there are several legal problemes in implementation because of the absence of money to be reserved or his absence ,or absence of funds . For that the algerian legislator Intervened by setting up a fund 15-01 Special act for alimony act the latter specified the benficiary (the child and the divorced women ) And the condition that must fulfill the crédition of this fund.
