النظام القانوني للوالي المنتدب في التشريع الجزائري

Abstract

ملخص : لضمان حسن سیر في الإدارة العمومیة علي المستوى المحلي، قد أحدث المشرع الجزائري مقاطعات إدارية في ولايات الجنوب و المدن الكبرى وإحداث مدن جديدة ، و هذا ما تجسد فعلیا في سنة 2015 و 2018، غیر أن تحدید طبیعة هذه الهیئة الإداریة یشوبها نوع من الغموض و تثیر جدلا علي مستوى الفقه حول مدى دستوریتها و قانونیتها و لمعرفة مدى توفیق المشرع الجزائري بذلك اقتضى منا الأمر دراسة النظام القانوني للوالي المنتدب في التشريع الجزائري، باعتبار وظیفته من الوظائــف العلیا في الدولة، فإنه یخضــــــــــع إلى قواعد و الأحكام العامة المتعلقة بالتعیین في الوظائف السامیة في الدولة . Résume : Pour garantir la bonne gouvernance au niveau local, le législateur algérien a introduit des districts administratifs dans les États du sud et les grandes villes et créé de nouvelles villes, comme en témoignent en 2015 et 2018. Toutefois, la nature de cet organe administratif est quelque peu ambiguë. Un débat au niveau de la jurisprudence sur l'étendue de sa constitution et de sa légalité et sur le degré de satisfaction du législateur algérien nous a obligés à étudier le système juridique du gouverneur délégué par la législation algérienne, en fonction des postes les plus élevés dans le pays, sous réserve des règles et dispositions générales relatives à la nomination à des postes élevés dans l'État Abstract : To ensure good governance at the local level, the Algerian legislator has introduced administrative districts in the southern states and major cities and created new cities, which is effectively reflected in 2015 and 2018.
