ضمانات حبس الطفل الجانح مؤقتا في ظل القانون الجزائري

Abstract

ملخص تعتبر مرحلة الطفولة مرحلة حساسة في حياة الفرد يمكن أن يرتكب الصغير فيها أفعالاً مخالفة للقانون تكيف ضمن نطاق الجنوح، ولي يتم التعامل تلك الظاهرة ومواجهتها قام المشرع الجزائري بإقرار ضمانات قانونية خاصة لا سيما أثناء حبس الطفل الجائح مؤقتا. اذ أن الحبس المؤقت هو إجراء من اجراءات التحقيق ،يهدف إلى تحقيق التوازن بين مصلحة المجتمع من جهة ومصلحة الفرد من جهة أخرى ، إلا أنه في ذات الوقت يشكل اعتداء صارخًا على قرينة البراءة و الحرية الفردية Résumé : L'enfance est considérée comme une période sensible dans la vie de la personne dans laquelle, il ou elle, peut commettre des actes contraires à la loi.
