المسؤولية المدنية للطبيب عن الإخلال بالإلتزام بالإعلام

Abstract

الملخص: إن العلاقة الموجودة بين الطبيب والمريض تتصف بعدم التوازن بين المركز القانونية لأطرافها،بحيث يلزم القانون الطبيب اعتباره الطرف المحترف،بإعلام المريض بكافة المعلومات التي تمكنه من اتخاذ قرار بالموافقة أو الرفض للتدخل الطبي فعند عدم قيامه بذلك فإن خطأه هذا الذي ينتج ضررا للمريض يجعله مسؤول ومن ثم يمكن مطالبته بالتعويض سواءا عن الضرر المادي أو المعنوي إلا أنه يمكن تأمين هذه المسؤولية لدي شركات التأمين حيث تتكفل هذه الأخيرة بالتعويض ليؤدي الطبيب عمله بأريحية Résumé La relation existante entre le médecin et le patient se caractérise par un déséquilibre entre le statut juridique de ses parties, de sorte que la loi oblige le médecin à le considérer comme le professionnel, à informer le patient de toutes les informations lui permettant de prendre la décision d'approuver ou de rejeter l'intervention médicale. Ensuite, on peut lui demander une indemnisation, que ce soit pour dommage matériel ou moral, mais cette responsabilité peut être assurée auprès des compagnies d'assurances, où ces dernières sont responsables de l'indemnisation afin que le médecin accomplisse son travail confortablement. Abstract The existing relationship between doctor and patient is characterized by an imbalance between the legal status of its parts, so that the law obliges the doctor to consider him as the professional, to inform the patient of all the information allowing him to take the decision to approve or reject the medical intervention. Then we can ask him for compensation, whether for material or moral damage, but this liability can be insured with the insurance companies, where the latter are responsible for the compensation so that the doctor can perform his work comfortably.
