Abstract

ﻣﻠﺨﺺ ﺑﻌﺪ إدراج ﻗﻀﻴﺔ اﻟﺒﻴﺌﺔ ﺿﻤﻦ ﻣﻮاﺿﻴﻊ اﻟﺘﻨﻤﻴﺔ اﻟﻤﺴﺘﺪاﻣﺔ ،أﺻﺒﺤﺖ ﺿﺮورة اﻟﻤﻮازﻧﺔ ﺑﻴﻦ اﻟﺘﻨﻤﻴﺔ اﻻﻗﺘﺼﺎدﻳﺔ و ﺑﻴﻦ اﻟﺤﻔﺎظ ﻋﻠﻰ اﻟﺒﻴﺌﺔ ﺑﻀﺒﻂ ﻣﺸﻜﻠﺔ اﻟﺘﻠﻮث اﻟﺒﻴﺌﻲ و اﻟﺼﻨﺎﻋﻲ و ﻣﻮاﺟﻬﺔ ﺧﻄﺮ اﻟﻨﻔﺎﻳﺎت اﻟﺼﻨﺎﻋﻴﺔ ﻟﻼﺳﺘﺜﻤﺎرات اﻷﺟﻨﺒﻴﺔ ﻣﻦ اﻟﻀﺮورﻳﺎت واﻷوﻟﻮﻳﺎت،ﺣﻴﺚ ﻧﺺ اﻟﺘﻌﺪﻳﻞ اﻟﺪﺳﺘﻮري ﻟﺴﻨﺔ2016ﻋﻠﻰ اﻟﺤﻖ ﻓﻲ اﻟﺒﻴﺌﺔ ﻛﺄﺣﺪ اﻟﺤﻘﻮق اﻹﻧﺴﺎﻧﻴﺔ اﻟﻤﻬﻤﺔ ، اﻟﻮاﺟﺐ ﻣﺮاﻋﺎﺗﻬﺎ و اﻟﺤﻔﺎظ ﻋﻠﻴﻬﺎ ، وأﻟﺰم ﻗﺎﻧﻮن اﻻﺳﺘﺜﻤﺎر اﻟﻤﺴﺘﺜﻤﺮﻳﻦ اﻟﻮﻃﻨﻴﻴﻦ واﻷﺟﺎﻧﺐ ﻗﺒﻞ ﻣﻨﺤﻬﻢ اﻟﻤﻮاﻓﻘﺔ ﻋﻠﻰ إﻗﺎﻣﺔ ﻣﺸﺎرﻳﻌﻬﻢ اﻻﺳﺘﺜﻤﺎرﻳﺔ ﻣﺮاﻋﺎة اﻟﺒﻌﺪ اﻟﺒﻴﺌﻲ ﻛﻘﻴﺪ ﻋﻠﻰ ﺣﻘﻬﻢ ﻓﻲ اﻻﺳﺘﺜﻤﺎر ﻓﻲ اﻟﺠﺰاﺋﺮ ، واﻵﻟﻴﺎت ﻟﻀﻤﺎن اﺣﺘﺮام اﻟﺒﻴﺌﺔ ﻓﻲ إﻃﺎراﻻﺳﺘﺜﻤﺎرات اﻷﺟﻨﺒﻴﺔ ﻓﻲ اﻟﺠﺰاﺋﺮ،ﻣﻦ ﺧﻼل ﺣﺮﺻﻬﺎ ﻋﻠﻰ ﻋﺪم اﻟﺴﻤﺎح إﻧﺠﺎز اﻟﻤﺸﺎرﻳﻊ اﻻﺳﺘﺜﻤﺎرﻳﺔ إﻻ ﺑﻌﺪ إﺛﺒﺎت ﺻﺎﺣﺐ اﻟﻤﺸﺮوع أن ﻣﺸﺮوﻋﻪ ﻟﻦ ﻳﻀﺮ ﺑﺎﻟﺒﻴﺌﺔ وﻟﻦ ﻳﺆﺛﺮ ﻋﻠﻰ اﻟﻌﻨﺎﺻﺮ اﻟﻄﺒﻴﻌﻴﺔ ﻛﺬﻟﻚ اﻹﺗﻔﺎﻗﻴﺎت اﻟﺪوﻟﻴﺔ وﻫﺬا ﻣﺎ ﻧﺼﺖ ﻋﻠﻴﻪ. Résumé Après avoir inclus la question de l'environnement dans les thèmes du développement durable, la nécessité d'un équilibre entre le développement économique et la préservation de l'environnement en maîtrisant le problème de la pollution environnementale et industrielle et en faisant face au danger des déchets industriels pour les investissements étrangers est devenue une nécessité et une priorité, l'amendement constitutionnel de 2016 stipulant le droit à l'environnement comme l'un des droits. Une humanité importante, qui doit être observée et préservée, et la loi sur l'investissement obligeait les investisseurs nationaux et étrangers avant de leur accorder l'agrément à établir leurs projets d'investissement à prendre en compte la dimension environnementale comme restriction à leur droit d'investir en Algérie, et les mécanismes pour assurer le respect de l'environnement dans le cadre des investissements étrangers en Algérie, par leur acuité À condition que les projets d'investissement ne puissent être achevés qu'après que le maître d'ouvrage ait prouvé que son projet ne nuira pas à l'environnement et n'affe. abstract After including the environment issue within the topics of sustainable development, the necessity of a balance between economic development and environmental preservation by controlling the problem of environmental and industrial pollution and facing the threat of industrial waste for foreign investments has become a necessity and priority, as the 2016 constitutional amendment stipulated the right to the environment as one of the rights Important humanity, which must be observed and preserved, and the investment law obligated national and foreign investors before granting them approval to establish their investment projects to take into account the environmental dimension as a restriction on their right to invest in Algeria, and the mechanisms to ensure respect for the environment within the framework of foreign investments in Algeria, through its keenness Provided that investment projects are not allowed to be completed until after the project owner has proven that his project will not harm the environment and will not affect the natural elements, This is also stipulated in international agreements.
