Abstract

الملخص: في التعديل الدستوري لسنة 2020 كرس المؤسس الدستوري الجزائري رقابة دستورية القوانين على نحو مخالف لما تضمنه التعديل الدستوري لسنة 2016، وذلك بإستحداث هيئة قضائية (محكمة دستورية) كمؤسسة دستورية مستقلة تتولى الرقابة على دستورية القوانين عوضا عن المجلس الدستوري، الذي له دور استشاري أكثر منه رقابي. المجلس الدستوري يبدي رأي على خلاف المحكمة الدستورية التي تفصل بقرار في رقابة الدستورية وآلية الدفع بعدم الدستورية، مع إخضاع الأوامر لأول مرة لرقابة الدستورية. Résumé: Dans l'amendement constitutionnel de 2020, le fondateur constitutionnel algérien a établi le contrôle de la constitutionnalité des lois d'une manière contraire à ce qui était inclus dans l'amendement constitutionnel de 2016, en créant un organe judiciaire (la Cour constitutionnelle) en tant qu'institution constitutionnelle indépendante qui contrôle la constitutionnalité des lois en lieu et place du Conseil constitutionnel, qui a un rôle consultatif plutôt que de contrôle . Le Conseil constitutionnel exprime un avis à la différence de la Cour constitutionnelle, qui statue par une décision sur le contrôle constitutionnel et le mécanisme d'appel à l'inconstitutionnalité, les ordonnances étant soumises pour la première fois au contrôle constitutionnel. Summary: In the constitutional amendment of 2020, the Algerian constitutional founder established the oversight of the constitutionality of laws in a manner contrary to what was included in the constitutional amendment of 2016, by creating a judicial body (the Constitutional Court) as an independent constitutional institution that monitors the constitutionality of laws instead of the Constitutional Council, which has an advisory rather than an oversight role . The Constitutional Council expresses an opinion, unlike the Constitutional Court, which decides by a decision on constitutional oversight and the mechanism for advocating unconstitutionality, with orders being subject for the first time to constitutional oversight.
