النظام القانوني للأملاك الوطنية العمومية في الجزائر

Abstract

ملخص : تـعتبر الأملاك الوطنية العمومية ثروة هامة للأجيال و وسيلة تعتمدها الدولة و الجماعات المحلية لممارسة نشاطها، و انجاز مشاريعها بهدف تحقيق المنفعة العامة. يـعتمد تسيير و إدارة الأملاك الوطنية العمومية، على الجانب التنظيمي الذي يلعب فيه التشريع دورا هاما، برصد قواعد قانونية و أجهزة إدارية تسهر على تنظيمه لتسهيل استعماله من طرف الجمهور. كـما تتقاسم كل من الإدارة و القضاء الإداري، مسؤولية حماية هذه الأملاك، بغية ردع كل معتد عليها سواء من الإدارة أو الأفراد.

Résumé : La propriété publique nationale est une richesse importante pour les générations et un moyen adopté par l'Etat et les communautés locales pour mener à bien ses activités et réaliser ses projets dans l'intérêt du public. La gestion et la gestion des biens publics nationaux, sur l'aspect organisationnel dans lequel la législation joue un rôle important, dépendent du contrôle des règles juridiques et des organes administratifs qui sont réglementés pour faciliter leur utilisation par le public. L'administration et le pouvoir judiciaire administratif partagent la responsabilité de protéger ces biens afin de dissuader tout agresseur, qu'il s'agisse de l'administration ou des individus.
