Abstract

الملخص : يعتبر الخطأ المرفقي ركنا أساسيا في تحديد مسؤولية المؤسسات العمومية الإستشفائية، و بإثباته يتحصل المضرور من التعويض نتيجة الأضرار التي تسببها نشاطاتها، و مصطلح الخطأ المرفقي يقتضي تمييزه عن الخطأ الشخصي لعدة أسباب أهمها تحديد المسؤول عن الضرر و كذا الجهة المختصة في ذلك. وأحكام هذه المسؤولية تمتاز بطابع خاص تتماشى مع الأهداف المسطرة لهذه المؤسسات، حماية للمتضررين من الأخطاء المرفقية.

Résumé: La faute de service est un élément essentiel dans la détermination de la responsabilité des établissements publique hospitalière et en prouvant que la personne blessée obtient d'indemnisation à la suite de dommages causés par ses activités, le terme «faute de service» nécessite de la distinguer de faute personnelle pour plusieurs raisons, la plus importante étant l'identification de la personne responsable du dommage et de l'autorité compétente. Les dispositions de cette responsabilité sont d'une nature particulière en accord avec les objectifs établis de ces institutions, Protection pour les personnes affectées par des fautes de service.
