إشكالات الطلاق في قانون الاسرة الجزائري دراسة مقارنة مع الشريعة الاسلامية

Abstract

ملخص : إن الزواج يشكل البنية الأساسية التي يقام عليها المجتمع و تبنى به الأمة و لنجاحه حث الشرع على إختيار الزوجين على اساس الدين ، وجعل لكل منهما حقوقا وواجبات عند التقصير فيها تسود المشقة و العناء، فيكون الطلاق هو الحل الاخير بعد فشل الحلول الأخرى، ولهذا فإن عدم تطبيق السليم لشريعة الإسلامية من قبل الزوجين و عدم مطابقة القانون الوضعي للشرع، يجعل المجتمع غير مستوى يتخبط في مشاكل لا حل لها وإن كان الطلاق نتيجة حتمية يوقعه الزوج بارادته المنفردة نص عليه الشرع وأقره قانون الأسرة الجزائري، إلا أن إسقاط هذه النصوص في الواقع العملي تثار عدة إشكالات تظهر عدم إنسجام أحكام القانون مع أحكام الشرع Résumé : Le mariage est la structure de base sur laquelle la société est fondée et adoptée par la Oumma et pour son succès.L'exhortant la charia à choisir le couple sur la base de la religion et à leur conférer des droits et des devoirs lorsque la défaillance est difficile et que le divorce est la solution finale après l'échec d'autres solutions. La bonne application de la loi islamique par les époux et la non-conformité de la loi positive de la loi font de la société un niveau qui plonge dans des problèmes non résolus, bien que le divorce soit un résultat inévitable signé par le mari dans son seul testament stipulé dans la charia et approuvé par la loi algérienne sur la famille.
