Abstract

الملخص: تعد رخصة البناء كوسيلة أولية تسمح بالمراقبة المسبقة، والتحقق من مدى تناسق المشروع المراد إنجازه مع أحكام البناء. كما تسمح بالمراقبة أثناء الإنجاز وبعده، لذلك اشترط المشرع الجزائري ضرورة الحصول على رخصة البناء قبل الشروع في أي تشييد لبناية، أو أي تحويل لبناية قائمة، موازنا في ذلك بين المصلحة الخاصة للأفراد والمصلحة العامة،في مختلف القوانين التي تضمنت أحكام رخصة البناء، والتي كان آخرها المرسوم التنفيذي رقم 15-19 المؤرخ في 25 يناير 2015، الذي يحدد كيفيات تحضير عقود التعمير وتسليمها. Résumé: Le permis de construire est considéré comme un moyen essentiel de permettre un suivi préalable et de vérifier la cohérence du projet à réaliser avec les dispositions relatives à la construction. Abstract : The building permit is considered as a primary means to allow prior monitoring and to verify the consistency of the project to be achieved with the construction provisions.
