ضمانات حماية الطفل الجانح في التشريع الجزائري

Abstract

الملخص: إن الاهتمام بالطفولة له الأثر البالغ في تحسين وضعية المجتمع، فطفل اليوم هو رجل أو امرأة الغد، إلا أنه نظرا لإجتماع عدة عوامل والتي تدفع بالطفل إلى الجنوح، وبالتالي الإتيان بسلوكات مخالفة للقانون وارتكاب جرائم اتجاه المجتمع الذي يعيش فيه. وأمام هذا الوضع فقد خطى المشرع الجزائري خطوة كبيرة في مجال حماية الطفل الجانح، وذلك بقصد وضع الحلول القانونية لعلاج ظاهرة الجنوح لدى الأطفال، وذلك من خلال مجموعة من النصوص القانونية التي أقرت بدورها عدة ضمانات لحماية هذه الفئة سواء كان ذلك قبل تحريك الدعوى العمومية أو بعد تحريكها، وذلك على اعتبار أن الهدف من هذه الضمانات يهدف بالدرجة الأولى إلى حماية الطفل الجانح من جهة، وكذا إصلاحه وإعادة إدماجه في المجتمع من جهة أخرى. Résume : La préoccupation pour les enfants a un impact majeur sur l’amélioration du statut de la société. L’enfant d’aujourd’hui est un homme ou une femme de demain. Cependant, en raison d’une combinaison de facteurs, l’enfant est motivé par la délinquance, et donc par un comportement illégal et la perpétration de crimes envers la société dans laquelle il vit. Le législateur algérien a fait un pas important dans le domaine de la protection des enfants en conflit avec la loi, en vue d’établir des solutions juridiques pour le traitement du phénomène de la délinquance chez les enfants, à travers une série de textes juridiques, qui établissent un certain nombre de garanties pour la protection des enfants en conflit avec la loi, que ce soit avant ou après l’ouverture de procédures publiques. Ces mesures de protection visent principalement à protéger les enfants qui ont des démêlés avec la justice et à les réformer et à les réintégrer dans la société. The Algerian legislature has taken a major step in the area of the protection of children in conflict with the law, with a view to establishing legal solutions for the treatment of the phenomenon of delinquency in children, through a series of legal texts, which establish a number of safeguards for the protection of children in conflict with the law, whether before or after public proceedings are initiated.
