المبادئ القانونية لحماية البيئة من مخاطر الاقامة العشوائية للمشاريع الاستثمارية

Abstract

الملخص: تهدف هذه الدراسة إلى تحليل واقع المشاريع الإستثمارية في إطار علاقتها مع البيئة من منظور قانوني يعتمد على تشخيص ظاهرة الإقامة العشوائية لهذه المشاريع في المقام الأول وتحديد المخاطر البيئية الناجمة عنها، ومن ثم إبراز المنهج التشريعي المتبع على المستوى الوطني للحد من هذه الظاهرة والتقليل من مخاطرها، وهو منهج قوامه الاستدامة اعتمد فيه المشرع الجزائري على تبني مبادئ عامة في القانون رقم 03-10 المتعلق بحماية البيئة في إطار التنمية المستدامة. وتفرض المعالجة البحثية لهذه المبادئ منهجية محكمة تتبع الاطار العام للدراسة، حيث تم توزيع المبادئ على مراحل تشكل المشاريع بين مبادئ تتعلق بمرحلة انجاز المشروع الإستثماري، ومبادئ أخرى تحكم مرحلة الإستغلال وبداية النشاط الفعلي للمشروع، كما تم مناقشة مختلف الآليات التي أوجدها القوانين والتنظيمات تكريسا لهذه المبادئ، من اجل تحقيق تدخل حمائي متكامل يشمل جميع مراحل تشكل هذه المشاريع، وتُظهر الدراسة أن اعتماد قواعد قانونية مرنة قائمة على مبادئ حماية البيئة يُعدّ حلاً فعّالًا لمواجهة تحديات الاستثمار غير المستدام، من خلال تمكين الإدارة والقضاء من ضبط الأنشطة اللاستثماية والحد من مخاطرها، كما تسمح لهم هذه المرونة بالتدخل وابتكار قواعد خاصة تتلاءم مع خصوصية المشكلات البيئية المطروحة. Abstract: This study aims to analyze the reality of investment projects in relation to the environment from a legal perspective. It begins by diagnosing the phenomenon of random establishment of these projects and identifying the resulting environmental risks. Then, It highlight the legislative approach adopted at the national level to limit this phenomenon and reduce its risks. This approach is based on the pillars of sustainable development. Were the Algerian legislator relied on the adoption of general principles in Law No. 03-10 relating to environmental protection within the framework of sustainable development. The research treatment of these principles requires a structured methodology aligned with the overall framework of the study. Accordingly, the principles were distributed across the different stages of project development: some relate to the project implementation phase, while others govern the operational phase and the commencement of actual activity. The study also examines the various legal and regulatory mechanisms established to implement these principles, with the aim of ensuring comprehensive environmental protection covering all stages of project formation.The study demonstrates that adopting flexible legal rules based on environmental protection principles constitutes an effective solution to addressing the challenges of unsustainable investment. Such flexibility enables administrative and judicial authorities to regulate investment activities and reduce their environmental risks, while also allowing them to intervene and develop tailored rules suited to the specific nature of environmental issues encountered. Résumé: Cette étude vise à analyser la réalité des projets d’investissement dans le cadre de leur relation avec l’environnement d’un point de vue juridique. Notre point de départ est le diagnostic du phénomène de la réalisation aléatoire de ces projets et l’identification des risques environnementaux qui en découlent, puis de délimiter le cadre législatif appliqué au niveau national pour restreindre ce phénomène et ses risques. On a opté pour une approche basée sur la durabilité dont le législateur algérien s’est appuyé sur l’adoption de principes généraux dans le cadre de la loi n° 03-10 relative à la protection de l’environnement dans le cadre du développement durable. Le traitement de ces principes impose une méthodologie rigoureuse conforme au cadre général de l’étude. Ainsi, les principes ont été répartis selon les différentes phases de réalisation des projets, certains concernent la phase de réalisation du projet d’investissement, tandis que d’autres régissent la phase d’exploitation et le début de l’activité effective. L’étude examine également les différents mécanismes juridiques et réglementaires mis en place pour concrétiser ces principes, afin d’assurer une protection environnementale intégrée couvrant l’ensemble des étapes de formation de ces projets. L’étude démontre que l’adoption de règles juridiques souples fondées sur les principes de protection de l’environnement constitue une solution efficace pour faire face aux défis des investissements non durables. Cette souplesse permet aux autorités administratives et judiciaires de réguler les activités d’investissement et d’en limiter les risques environnementaux, tout en leur offrant la possibilité d’intervenir et d’élaborer des règles spécifiques adaptées à la nature particulière des problématiques environnementales
