النظام المالي بين الزوجين في القانون الأسرة الجزائري

Abstract

Observation : The financial system between spouses is a set of rules that govern the financial relations between spouses and among others , the financial relationship between spouses varies depending on the financial system adopted by them , the Algerian legislator took into account what stated in Islamic law ,before and after the 2005 amendment , it considers that the basis of financial responsibility between souses is the independence of each spouse in their responsibility . This is a system of financial independence according to article 37/1 of the Algerian family code , each spouse Romains responsible for their debts , whether before or after marriage. Due to economic and social changes , the legislator added a new system as an exception to the rule in paragraph 2 of article 37 , this is a system of financial partnership the legislator allowed the spouses to agree in the subsequent official contract to share the financial assets between them , while specifying the percentages that go to each of them RESUME : Le système financier entre époux est un ensemble de règles qui régissent le relations financières entre époux et entre autres , la relation financière entre les époux varie en fonction du système financier adopté par eux , le législateur algérien a pris en compte ce qui était énoncé dans la loi islamique , avant et après l’amendement de 2005 , il considère que le fondement de la responsabilité financière entre époux est l’indépendance de chaque époux dans sa responsabilité ; IL s’agit d’un système d’indépendance financières selon l’article 37 /1 du code de la famille algérien , chaque époux restant responsable de ses dettes , que ce soit avant ou après le mariage . En raison des changements économiques et sociaux , le législateur à ajouter un nouveau système comme exception à la règle dans l’alinéa 2 de l’article 37 , IL s’agit d’un système de partenariat financier , le législateur à permis aux époux de convenir dans le contrat officiel ultérieur de partager les biens financiers entre eux , tout en précisant les pourcentages qui revienment à chacun d’eux.
