Abstract

تتناول في هذه الورقة البحثية موضوع استرداد عائدات الفساد وتداعياته في السياق الجزائري، مسلطا الضوء على الإطار القانوني والمؤسساتي الذي تبنته الدولة لمكافحة الجرائم المالية وتتبع الأموال المنهوبة، سواء على المستوى الداخلي أو الخارجي، وتبرز الدراسة أهمية تفعيل آليات التعاون الدولي والاتفاقيات الثنائية، والمساعدة القضائية المتبادلة لتجاوز العقبات القانونية والسياسية العابرة للحدود، كما توصلنا إلى أن نجاح عملية استرجاع هذه الأصول ينعكس إيجابا على الاقتصاد الوطني عبر ضخها في الخزينة العمومية وتمويل المشاريع التنموية، ناهيك عن أثره البالغ في تكريس مبدأ عدم الإفلات من العقاب، تعزيز سيادة القانون، واستعادة ثقة المواطن في مؤسسات الدولة. Ce document de recherche examine la question du recouvrement des produits de la corruption et ses répercussions dans le contexte algérien, Il met en évidence le cadre juridique et institutionnel adopté par l'État pour lutter contre la criminalité financière et traquer les fonds détournés, tant au niveau national qu'international. L'étude souligne l'importance d'activer les mécanismes de coopération internationale, les accords bilatéraux et l'entraide judiciaire pour surmonter les obstacles juridiques et politiques transfrontaliers, Elle conclut également que le succès du processus de récupération de ces avoirs a un impact positif sur l'économie nationale par leur réinjection dans le Trésor public et le financement de projets de développement, sans oublier son effet profond sur la lutte contre l'impunité, le renforcement de l'État de droit et la restauration de la confiance des citoyens dans les institutions de l'État. Abstract This research paper examines the issue of recovering the proceeds of corruption and its implications within the Algerian context. It highlights the legal and institutional framework adopted by the state to combat financial crimes and track embezzled funds, both domestically and internationally, The study emphasizes the importance of activating international cooperation mechanisms, bilateral agreements, and mutual legal assistance to overcome cross-border legal and political obstacles, It also concludes that the successful recovery of these assets positively impacts the national economy by reinjecting them into the public treasury and financing development projects, in addition to its profound effect on ending impunity, strengthening the rule of law, and restoring citizens' trust in state institutions.
