Abstract

الملخص باللغة العربية تتلخص هذه الد ا رسة في الوقوف على التنظيم القانوني للفضاء الخارجي بعد أن أصبح ساحة منافسة عسكرية بين القوى العظمى بهدف السيطرة عليه واستغلاله لمصلحتها الخاصة بما يتعارض بشكل كامل مع مصالح الدول الأخرى، وقد أجبر هذا المجتمع الدولي ممثلاً في هيئة الأمم المتحدة وأجهزتها الدولية على وضع مثل هذه القواعد والمبادئ التي خففت من خطر حرمان الدول الصغيرة من حرية استكشاف واستغلال الفضاء، وهذا الحق كفله مبدأ حرية استكشاف الفضاء الخارجي واستغلاله، وهو مبدأ مُنح على قدم المساواة لجميع الدول؛ نظرا لأنه قد تُحرم الدول الصغيرة من الوصول إلى جزء من الفضاء الخارجي قبل أن تصل إليه دولة أخرى، ولهذا تنص هذه المبادئ والقواعد على جعل الفضاء الخارجي ت ا رثًا مشتركًا للبشرية جمعاء بحيث لا يمكن لأي دولة السيطرة عليه أو المطالبة بملكيته الكاملة أو الجزئية، وقد يكون الفضاء الخارجي أيضًا مصدر تهديد للأمن يمكن استخدامه في أعمال العدوان، ونص القانون على مبدأ الاستخدام السلمي الذي يحظر أي استخدام للفضاء الخارجي في أعمال عدوانية. الملخص باللغة الإنجليزية This study aims to stand on the legal regulation of outer space after it has become an arena of military competition between the superpowers with the aim of controlling it and exploiting it for their own benefit in complete contradiction with the interests of other countries, and this forced the international Community represented by the United Nations and its international bodies to put such Rules and principles that have mitigated the danger of depriving small States of the freedom to explore and exploit space, and this right is guaranteed by the principle of freedom of exploration and exploitation of outer space, which is a principle granted on an equal footing to all States; Since small countries may be denied access to a part of outer space before another country reaches it, and for this reason these principles and rules provide for making outer space the common heritage of all mankind so that no country can control it or claim full or partial ownership of it, and space may be Foreign space is also a source of threat to security that can be used in acts of aggression, and the law stipulates the principle of peaceful use, which prohibits any use of outer space in acts of aggression. الملخص باللغة الفرنسية Cette étude résume la régulation juridique de l’espace extra-atmosphérique après qu’il soit devenu une arène de compétition militaire entre les grandes puissances dans le but de le contrôler et de l’exploiter à leur propre bénéfice, en total conflit avec les intérêts des autres pays.
